By accessing or using the Gauge platform, including the website at gauge.tools, any associated APIs, browser extensions, or related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Gauge Analytics OÜ ("Gauge", "we", "us", "our"). Continued use of the Service after any amendment to these Terms constitutes acceptance of the amended Terms.

The Service provides gas fee analytics, multi-network gas price monitoring across Ethereum, Base, Arbitrum, Optimism, Polygon and other supported networks, transaction timing analysis and recommendations, historical gas expenditure analysis for public wallet addresses, and configurable fee threshold alerts.
Gauge analyses public on-chain data only. We do not custody assets, do not hold private keys, do not execute transactions, and never request signing rights. No wallet connection is required to use the Service.
All data displayed by the Service is derived from publicly available blockchain state. Gauge does not operate any blockchain network and has no ability to affect transaction processing, ordering, or execution.
To use the Service you must: (a) be at least 18 years of age; (b) have the legal capacity to enter into binding agreements under applicable law; and (c) not be listed on, or acting on behalf of any person or entity listed on, any sanctions list maintained by the European Union, the United Nations, or the United States Office of Foreign Assets Control (OFAC).
By using the Service, you represent and warrant that you meet all eligibility requirements. Gauge reserves the right to refuse or terminate access where eligibility requirements are not met.
Certain features of the Service, including the API tier and configurable alerts, require account registration. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activity that occurs under your account.
You must notify Gauge immediately at [email protected] if you become aware of any unauthorized use of your account or API key. Gauge will not be liable for losses arising from unauthorized use of your credentials.
Subject to your compliance with these Terms, Gauge grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal business purposes. This licence does not include the right to sublicense, resell, or commercially exploit the Service or its outputs without a separate written agreement with Gauge.
API access is subject to rate limits specified in your account plan documentation. You must include proper attribution when displaying Gauge data in third-party applications, as specified in the API documentation. Fair use applies: automated querying that exceeds published rate limits, or that is designed to circumvent rate limiting, is prohibited and will result in access termination without refund.
Resale of raw API data, or provision of a competing service built primarily on Gauge API output, requires a separate data licence agreement. Contact [email protected].
You agree not to:
Gauge Analytics OÜ owns all right, title, and interest in and to the Service, including the platform software, analytical methodology, visual presentation, design, trademarks, and trade secrets. Public on-chain data is not owned by Gauge or by any other party — it is part of the public record of the relevant blockchain network.
You may not copy, reproduce, distribute, or create derivative works from any proprietary element of the Service without express written consent from Gauge.
The Service sources data from third-party RPC providers, block explorers, and other infrastructure providers. Gauge is not responsible for the accuracy, completeness, or availability of data provided by third parties. Third-party data may lag, contain errors, or be temporarily unavailable. Gauge aggregates and presents this data in good faith but makes no warranty as to its accuracy.
Nothing on the Gauge platform constitutes financial advice, investment advice, trading advice, or any other form of advice. Gas fee data, timing recommendations, and cost analyses are informational only. You are solely responsible for your transaction decisions. Consult a qualified financial adviser if you require advice.
Gauge provides the Service on a best-efforts basis. We do not guarantee continuous, uninterrupted, or error-free operation. Scheduled and emergency maintenance may cause temporary unavailability. No service level agreement (SLA) applies to free or standard paid tiers. Enterprise customers may negotiate SLA terms separately.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. GAUGE DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DATA PROVIDED IS ACCURATE OR CURRENT.
To the extent permitted by applicable EU law, all implied warranties are excluded. Nothing in these Terms affects any statutory rights that cannot be waived or excluded under the laws of Estonia or applicable EU consumer legislation.
To the fullest extent permitted by applicable law, Gauge's total liability to you for any claim arising from or relating to these Terms or the Service shall not exceed the greater of (a) €100 or (b) the total fees you paid to Gauge in the twelve months preceding the claim.
Gauge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of transactions, even if Gauge has been advised of the possibility of such damages.
These limitations do not apply where prohibited by mandatory provisions of EU consumer law or Estonian law, including liability for death or personal injury caused by negligence, or liability for fraudulent misrepresentation.
If you are a consumer within the meaning of EU Directive 2011/83/EU (Consumer Rights Directive), acting outside your trade, business, craft, or profession, nothing in these Terms limits your statutory consumer rights under applicable EU or national law. This includes, where applicable, the right to withdraw from a contract for digital services within 14 days of conclusion, subject to the exceptions provided under Article 16 of that Directive.
EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr for the resolution of disputes arising from online contracts.
You agree to indemnify, defend, and hold harmless Gauge Analytics OÜ, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
Gauge may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms, for fraudulent or abusive behaviour, or at Gauge's reasonable discretion. On termination, your licence to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including Sections 9, 11, 13, 14, and 16.
Gauge may amend these Terms from time to time. Material changes will be communicated via the email address associated with your account or by prominent notice on the Service. The updated Terms will specify a new effective date. Your continued use of the Service after the effective date constitutes acceptance of the amended Terms. If you do not accept the amended Terms, you must cease using the Service.
These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Harju County Court (Harju Maakohus) in Tallinn, Estonia.
Notwithstanding the foregoing, EU consumers retain the right to bring proceedings in the courts of their country of domicile in accordance with applicable EU consumer protection legislation, including Regulation (EU) No 1215/2012 (Brussels I Recast).
Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Assignment. You may not assign or transfer your rights or obligations under these Terms without Gauge's prior written consent. Gauge may assign its rights under these Terms without restriction.
Entire Agreement. These Terms, together with the Privacy Policy and any applicable API or Enterprise terms, constitute the entire agreement between you and Gauge regarding the Service and supersede all prior agreements and understandings.
Notices. Notices from Gauge to you will be sent to the email address associated with your account or posted on the Service. Notices from you to Gauge must be sent to [email protected].
Force Majeure. Gauge shall not be liable for any failure or delay in performance arising from causes beyond its reasonable control, including but not limited to blockchain network failures, third-party infrastructure outages, acts of God, or government actions.
